Paul and Janet Smith are suing the Park City School District over the severe head injury of their daughter, Remy. A metal file flew across a classroom and lodged into her forehead over a year ago and she is still recovering from her injuries.
On Jan. 18, 2011, Remy Smith was in ceramics class at Park City High School when a fellow student was using a metal file to create a piece of jewelry.
The metal from the file detached, flew four or five feet through the air and struck Remy’s forehead, with the narrow tip in and became deeply imbedded.
Someone called 911 and an ambulance immediately transported Remy to the University of Utah Hospital in Salt Lake City for emergency care where she received surgeries to remove the file and have follow up care.
Remy has continued to have headaches, insomnia, cognitive deficits, anxiety, depression and other issues related to her injury.
According to the lawsuit filed in the Summit County Third District Court, the family is suing for extensive medical costs and ongoing medical care, as well as negligence for failing to supervise their students and protect Remy from injury, failing to properly train its employees to supervise and by allowing dangerous and defective instruments to be used by students on school premises.
