A trial scheduled to begin Tuesday for former college basketball standout Teddy Dupay has been cancelled and the 29-year-old Salt Lake County resident is expected to change his plea of not guilty in the case, according to Summit County prosecutors.
“The victim in this matter has been very adamant that she wants a different result,” Summit County Attorney David Brickey said. “Every case is driven by the willingness and cooperation of the victim.”
Dupay was charged with aggravated kidnapping, aggravated rape and aggravated sexual assault in a case that stems from a confrontation at Stein Eriksen Lodge last June. A 3rd District Court judge has released a pool of potential jurors that was scheduled to gather in the case. Dupay’s trial was slated to begin March 24.
Charging documents describe the incident as an attack June 19 in room 119-2. The woman lives in Draper and said she had dated Dupay sporadically for about two years.
But Brickey said she lacks credibility, has retracted parts of her account of the evening and has refused to cooperate with prosecutors.
“We can’t create facts,” Brickey said. “The County Attorney’s Office and the law-enforcement officers have to work with the facts given to us. Juries do not appreciate being manipulated.”
The Park Record usually does not print the name of alleged rape victims.
Attorney Ed Brass, who represents Dupay, did not return telephone calls seeking comment.
The woman admitted in court she tried to contact Dupay several times after the alleged attack and sent him text messages within a few days of the incident. She also told attorneys she drank vodka in the room before dinner and had three or four alcoholic drinks while out that night with Dupay.
Dupay has not commented about the case.
Dupay started as a guard for the Florida Gators when the school lost to Michigan State in the 2000 NCAA championship game. A Florida spokeswoman said Dupay played basketball at the school from 1999 to 2001.
