The 3rd District Court judge who presided over the lawsuit between Park City Mountain Resort and its landlord, Talisker Land Holdings, LLC, on Monday afternoon electronically signed an order dismissing the case, officially ending the most dramatic legal case in Park City’s history.
Ryan Harris dismissed the case with prejudice, meaning that another lawsuit cannot be filed with the same claims. The judge electronically signed the order of dismissal at 1:50 p.m.
The dismissal was expected after a settlement was reached last week between the parties. Vail Resorts agreed to pay $182.5 million to purchase PCMR in a deal that effectively ended the litigation. Both sides sought the dismissal after the settlement was reached.
Colorado-based Vail Resorts oversaw the latter stages of the case on behalf of Talisker Land Holdings, LLC as part of a long-term deal to lease and operate the Talisker corporate family-owned Canyons Resort. The deal included the possibility of the agreement being extended to include the Talisker Land Holdings, LLC acreage underlying most of the terrain at PCMR that was disputed in the case.
The $182.5 million purchase involved PCMR terrain that was not owned Talisker Land Holdings, LLC, the parking lots, the base facilities, lifts, water rights and ski terrain that had been held by Ian Cumming.
